On August 20, 2025, the U.S. Court of Appeals for the Second Circuit vacated a district court ruling that shielded online auto software platform EZ Lynk from Clean Air Act liability under Section 230 of the Communications Decency Act.   The decision underscores the limits of Section 230 immunity for online platforms where allegations suggest active involvement in developing or promoting unlawful content. Sidley secured an appellate decision vacating a Surface Transportation Board (STB) rule that would have created a new avenue for shippers to obtain STB orders for forced reciprocal switching. The Sidley team, representing a coalition of three railroads who challenged the lawfulness of the final rule, was led by partner Raymond Atkins, who argued the case, and included Matt Warren, Allison Davis, Tobias Loss-Eaton, Morgan Lindsay, Stephen Laudone, and David Kinnaird.
