The regulatory landscape continues to evolve. A recent Executive Order from President Trump puts a spotlight on alleged politically motivated account closures and sets a tight timeline for regulators to respond. Regardless of how this develops, financial institutions should be assessing their policies, controls, and data to ensure consistency and fairness in decision-making. While the full impact remains to be seen, institutions should act now. This is a critical moment to: ✔ Reassess account closure and denial policies ✔ Review complaint and attrition trends for bias or inconsistencies ✔ Stress-test current governance and decision-making controls We help banks proactively navigate regulatory change—through policy and control reviews, targeted testing, data analysis, and response planning. President Trump signed an EO aimed at curbing politically or ideologically-motivated account closures by financial institutions. Key provisions include: ✅ Prohibiting institutions from denying services based on constitutional beliefs, affiliations, or political views ✅ Directing regulators (Treasury, OCC, FDIC) to investigate debanking practices, impose penalties, and refer violations to DOJ ✅ Eliminating “reputational risk” as a factor in regulatory evaluations (aligned with recent changes made to OCC examination procedures) ✅ Requiring the SBA to assist clients previously denied services ✅ Mandating a comprehensive strategy to prevent future politicized debanking Within 120 days, regulators must identify institutions with any formal or informal policies that may have encouraged politicized or unlawful debanking—and take remedial action. Sixty days later, they must, based on a review of supervisory and complaint data, flag any institution that has debanked individuals based on religion, with potential civil referrals to follow. The president and Republican officials have been vocal in accusing certain institutions of targeting conservatives and political allies. Regardless of where this leads, now is a prudent time for all institutions, to reassess key decisioning practices, review complaint and attrition data, and evaluate exposure.
