This week brought long-awaited certainty for commercial rooftop solar. Treasury’s newly released guidance confirms that the industry can rely on longstanding “beginning of construction” rules, vital for unlocking commercial rooftop solar at scale. Key takeaways for CRE owners: - Certainty is back. Projects started over the next year will qualify for the federal Investment Tax Credit (ITC), as well as any project energized by the end of 2027, providing clear ground rules for CRE portfolio planning. - Rooftop solar protected. Commercial rooftop projects (under 1.5 MWac) can still rely on the 5% safe harbor, while larger projects have the physical work test as a clear alternative. Both paths remain viable. - No retroactive surprises. The new rules apply only to projects beginning after September 2, 2025, so existing pipelines remain secure. - Bipartisan support for commercial rooftop solar. Policy makers recognized that commercial rooftop solar faces no NIMBY issues, leverages existing electrical infrastructure, and is the fastest (12-18 months to deploy) scalable way to meet rising energy demand and to reduce energy costs. What this means for CRE asset owners: There is now certainty but the window is finite. There are 11 months to begin construction on new projects that qualify under this guidance. CRE asset owners must swiftly identify sites, choose a developer partner, sign rooftop leases, and begin development work now.
