Congratulations to Senior Partner Zina Bash on being named a 2025 Attorney of the Year Finalist in the Texas Legal Awards by Texas Lawyer! Zina has been recognized for her leadership on behalf of the State of Texas in securing a record-breaking $1.4 billion settlement with Meta Platforms in Texas v. Meta Platforms Inc. The State had sued Meta for decades-long violations of Texans’ privacy rights, and the settlement helped deliver justice to tens of millions of Texans. Zina is also currently representing the State in its antitrust suit against Google in Texas v. Google, another high-stakes litigation seeking to vindicate the rights of Texans. These cases represent some of the most significant state-led litigation in the country, and Zina’s advocacy has helped set the standard for public-interest litigation nationwide. Retrial Granted in NEC Litigation Against Abbott and Mead Johnson On March 13, 2025, a significant victory was achieved as Judge Noble granted a retrial in Whitfield vs. Mead Johnson & Company, LLC, et al., citing defense misconduct. This decision, secured by Keller Postman's partners Benjamin Whiting and Amelia Frenkel alongside Simon Law and Cates Law, overturns a previous defense verdict. Benjamin Whiting stated: "This order sends a clear message that justice demands fairness and adherence to the law, not just in this case but in all litigation." As we mark the one-year anniversary of our first NEC trial victory, this ruling reinforces our commitment to holding manufacturers accountable and advocating for safer infant formulas. Keller Postman LLC Celebrates Unanimous Victory for Plaintiffs at the U.S. Supreme Court Keller Postman LLC is proud to announce that it has secured a momentous victory for plaintiffs across the country: The U.S. Supreme Court unanimously affirmed the appellate court’s decision in Royal Canin U.S.A., Inc. v. Wullschleger, reconfirming that plaintiffs are the masters of their complaints. Specifically, Justice Kagan’s opinion makes clear that when a plaintiff removes all federal claims from her complaint, federal courts are not allowed to interfere with the plaintiff’s decision to have her case heard in state court. The Supreme Court also made clear that this principle is a jurisdictional rule, such that when a plaintiff amends her complaint to destroy the basis for removal jurisdiction, the district court has no discretion to keep the case but rather must remand the case back to state court. The Supreme Court’s decision marks a sharp break from past practice, where plaintiffs were stripped of authority to dictate their choice of forum, even if they eliminated all federal claims from their complaints. Keller Postman Co-Founder Ashley Keller argued the case for respondents, and Noah Heinz played an integral role in briefing the jurisdictional dispute and helping Ashley prepare for oral argument.
